THORA LLC (“THORA”, “we”) respects the intellectual-property rights of others and expects users of the THORA platform (the “Service”) to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond expeditiously to valid claims of copyright infringement involving material stored on the Service at the direction of users, and we maintain a policy of terminating the accounts of repeat infringers in appropriate circumstances.

1. Designated Copyright Agent

Send copyright infringement notices to our designated agent:

Copyright Agent, THORA LLC
Legal Department
5473 Blair Rd, Ste 100 #140451, Dallas, TX 75231-4227, United States
Email: legal@thora-systems.com
Phone: +1 515-441-5403

2. Filing an infringement notice (takedown request)

If you believe material stored on the Service infringes your copyright, send our agent a written notice including all of the following (17 U.S.C. §512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
  3. Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it (for material inside a customer workspace, include the customer organization, project, and document/drawing name or URL if known).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

On receipt of a valid notice, we will remove or disable access to the identified material promptly, notify the user or customer organization that provided it, and provide them a copy of the notice.

Warning — misrepresentation: under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees.

3. Counter-notice

If you believe material you provided was removed or disabled by mistake or misidentification, you may send our agent a written counter-notice including:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its location before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, the Western District of Texas), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notice, we will forward it to the original complainant. Unless the complainant notifies us within ten (10) business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the removed material within ten (10) to fourteen (14) business days.

4. Repeat infringers

We will terminate, in appropriate circumstances, the accounts of users or customer organizations who are determined to be repeat infringers. We may also, at our discretion, limit access to the Service by, or terminate the accounts of, any user who infringes the intellectual-property rights of others, whether or not there is repeat infringement.

5. Scope notes

  • Most content on the Service lives inside private customer workspaces. Rights holders will usually learn of alleged infringement through their relationship with the customer (for example, an architect whose drawings were uploaded by a contractor). This process applies regardless of whether the material is publicly visible.
  • Under our Terms of Service and Cloud Service Agreement, each customer represents that it holds all licenses needed to upload and mark up design documents, and indemnifies THORA for claims arising from its content. This policy supplements — and does not limit — those obligations.
  • For trademark complaints or other intellectual-property concerns not involving copyright, contact legal@thora-systems.com.

6. Changes

We may update this policy from time to time; the current version is posted at this page with its effective date.
